Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the services provided by Fixate ("Fixate"). It is incorporated by reference into the Fixate Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.
By using Fixate, you agree not to engage in, attempt, facilitate, or authorize any of the prohibited activities below. Violation of this AUP is a material breach of the Terms and may result in suspension or termination of your account, with or without notice.
1. Prohibited Content
You may not use Fixate to transmit, store, or process content that:
- Is unlawful, fraudulent, deceptive, or misleading;
- Infringes any intellectual property, publicity, privacy, or other rights;
- Is defamatory, libelous, or slanderous;
- Is obscene, pornographic, sexually explicit, or harmful to minors;
- Promotes or incites violence, self-harm, terrorism, or hate speech;
- Contains personal health information, financial account numbers, government ID numbers, or other sensitive personal data beyond what is necessary for standard plumbing service intake;
- Constitutes spam, phishing, or other unsolicited bulk communications;
- Contains malware, viruses, or other malicious code.
2. Prohibited Activities
You may not:
2.1 Abuse the Service
- Reverse engineer, decompile, or attempt to extract the source code of the Service;
- Access the Service using automated means (bots, scrapers, crawlers) except as expressly permitted by us;
- Probe, scan, or test the vulnerability of any Fixate system without our written consent;
- Interfere with or disrupt the Service, servers, or networks;
- Circumvent rate limits, authentication, or other access controls;
- Use the Service to build a competing product or benchmark it without our written consent.
2.2 Misuse SMS Messaging
- Send messages without the recipient's prior consent as required by applicable law (CASL in Canada, TCPA in the US, and similar laws elsewhere);
- Send messages to phone numbers on Do-Not-Call or Do-Not-Message lists where required;
- Misrepresent the sender's identity or the nature of the message;
- Send messages unrelated to the plumbing services the recipient contacted you about;
- Ignore STOP / UNSUBSCRIBE requests;
- Use the Service to send messages in categories prohibited by carriers or Twilio, including but not limited to: illegal drugs, cannabis (where restricted), firearms, gambling, adult content, high-risk financial services, "get rich quick" schemes, debt collection that violates applicable law, or any category classified as SHAFT (Sex, Hate, Alcohol, Firearms, Tobacco) by mobile carriers where restricted;

2.3 Harm End Customers
- Use Fixate to harass, threaten, defraud, or deceive End Customers;
- Misrepresent pricing, availability, or qualifications;
- Collect personal information from End Customers beyond what is necessary to provide plumbing services;
- Share or sell End Customer data to third parties without proper consent and legal basis.
2.4 Violate Laws
- Use the Service in violation of any applicable law, regulation, or industry standard, including those relating to privacy, consumer protection, telemarketing, export control, or licensing of trades (e.g., plumbing trade licensing in your jurisdiction).
2.5 Account Abuse
- Share your account credentials with unauthorized persons;
- Create accounts using false information or impersonate another person or business;
- Maintain more accounts than your subscription permits in order to circumvent plan limits;
- Resell, sublicense, or provide the Service to third parties unless under a Fixate reseller or partner agreement.
2.6 AI Misuse
- Attempt to manipulate the Fixate AI to produce unlawful, harmful, or policy-violating output;
- Use AI-generated responses to provide professional advice outside the scope of plumbing intake (e.g., legal, medical, or financial advice);
- Rely solely on AI output for decisions affecting safety without human review.
3. Security Obligations
You agree to:
- Use strong, unique passwords and enable any multi-factor authentication we offer;
- Notify us promptly at [email protected] of any suspected security incident or unauthorized access;
- Not attempt to gain unauthorized access to any part of the Service, other accounts, or related systems.
4. Reporting Violations
If you become aware of any violation of this AUP, please report it to [email protected]. We investigate all credible reports and take appropriate action.
5. Enforcement
Fixate may, at its sole discretion and without liability:
- Investigate suspected violations;
- Remove or disable access to content that violates this AUP;
- Suspend or terminate accounts;
- Cooperate with law enforcement and regulatory authorities;
- Take any other action we deem appropriate.
Where practical and lawful, we will provide notice before taking enforcement action, but we may act immediately in cases involving legal risk, security threats, or carrier/regulator directives.
6. Changes
We may update this AUP from time to time. Material changes will be communicated with at least 14 days' notice. Continued use of the Service after the effective date constitutes acceptance.
